Public Offer
DARWIN EVOLUTION LIMITED LIABILITY COMPANY (hereinafter — the Club) offers individuals (hereinafter — the Client) the opportunity to use the Club's services under the terms of this Public Offer.
By making a booking and paying its cost in full or in part, the Client confirms familiarity with this Public Offer and agreement to its terms.
1. List and composition of services
The Club organizes and conducts shooting training, provides access to shooting galleries and Club weapons, ensures the work of instructors, and offers other related services.
The package selected by the Client or the Club's current rates determine the composition and cost of the service, its duration, the number of shots, the type of weapon, and the need for a personal instructor.
The Club may revise the range of services and rates. The cost of an already paid booking remains as agreed at the time of its arrangement.
2. Booking arrangement and acceptance of the offer
Services can be ordered on the Club's website, by phone, via messengers or social networks, and during a personal visit to the Club.
To confirm a booking, the Club must agree on the date and time of the visit, and the Client must make a prepayment if required by the booking terms.
By paying the full cost of the booking or the prepayment, the Client fully and without any reservations accepts the terms of this Public Offer.
Each participant must undergo a safety briefing before shooting and comply with the rules established at the Club.
3. Prices and payment methods
The price of services is set according to the Club's current rates and/or in accordance with the cost of the package selected by the Client.
Payment can be made in cash, by bank card, by non-cash transfer, or by any other method available at the Club or on its website.
Shots, time, weapons, personal instructor services, and other services beyond the scope of the selected package are paid additionally at the Club's current rates.
4. Safety priority and admission decision
Since the Club's services involve the use of weapons, compliance with safety rules is an unconditional requirement.
Ensuring the safety of Clients, employees, and all other persons takes priority over conducting or continuing training.
If the instructor has reasonable doubts about the possibility of safely conducting training, the Club has the right to deny the Client admission to shooting, refuse to start the session, or terminate it at any moment.
Such a decision may be caused, in particular, by the following circumstances:
- signs of alcohol, drug, or other intoxication;
- agitation, aggression, or another state of the Client that may affect safe weapon handling;
- inability or unwillingness of the Client to follow the instructor's commands;
- handling weapons in a manner that creates danger;
- gross violation of safety rules, even once, or repeated violations of such rules;
- actions or behavior that threaten the Client, Club staff, or other people;
- other circumstances in which the instructor has reasonable grounds to doubt the safety of conducting training.
Upon the instructor's request, the Client must immediately stop shooting, unload or set the weapon aside, and promptly follow other safety commands.
The authorized Club instructor makes the final decision on admission to shooting, continuation, or termination of training based on safety considerations.
5. Safe handling requirements during shooting
Participation in shooting is allowed only after undergoing the mandatory briefing and receiving permission from the Club instructor.
While at the shooting gallery, the Client must follow the instructor's commands and comply with all safety rules.
Without the instructor's permission, it is not allowed to:
- load or unload the weapon;
- point the weapon outside the permitted direction;
- leave the shooting position with the weapon;
- hand the weapon to another participant or another person;
- touch the weapon after the cease-fire command;
- take other actions that may endanger the life or health of people.
Any instructor's safety commands must be followed mandatorily and immediately.
6. Instructor support
The Club provides the necessary supervision of compliance with safety rules during shooting.
The safety instructor monitors compliance with safe weapon handling requirements. Their services do not include individual training in shooting technique.
A personal instructor teaches the Client individually and helps to master weapon handling technique, body position, grip, aiming, and other components of shooting.
If the Client has insufficient experience in safe weapon handling, the Club has the right to determine that the participation of a personal instructor is necessary.
The Club's instructor decides whether the safe conduct of the relevant training is possible.
7. Booking cancellation and date change
The Client may cancel the booking or reschedule it by notifying the Club at least 24 hours before the start of the booked time.
If the cancellation notice is received less than 24 hours in advance, the Client did not appear, or the booking was cancelled after the start of the booked time, the funds are refunded taking into account the Club's actual expenses, the reserved time, and the requirements of Ukrainian law.
If the service cannot be provided due to the Club's fault, the Client is offered another booking date or a refund for the service not provided.
8. Arrival at the Club and lateness
To arrange the visit and undergo the briefing, it is recommended to arrive 10–15 minutes before the start of the booked time.
If the Client is late, the duration of the training may be reduced by the time of lateness, provided that another booking is scheduled immediately after it.
If free time allows, the Club may ensure the full planned duration of the session by extending it.
9. Participation of minors
Minors are admitted to training in compliance with Ukrainian law and the Club's internal rules.
For such admission, the Club has the right to require the presence of one of the parents or a legal representative and/or the written consent of one of the parents or a legal representative.
The possibility of safe use of a particular type of weapon by a minor participant is assessed by the instructor.
For safety reasons, the Club may set restrictions on the types of weapons available, the number of shots, the exercises performed, or the session format.
10. Rules for using weapons and ammunition
Use of Club weapons is allowed only on its premises, in specially designated places, and according to the instructor's commands.
In case of temporary unavailability of a specific weapon unit due to repair, maintenance, or other objective circumstances, the Club has the right to offer an equivalent replacement.
Payment for ammunition is made under the terms of the selected package or for the actually used quantity according to current rates.
Personal weapons and/or ammunition may be used only after prior agreement with the Club, in compliance with Ukrainian law and Club rules.
11. Terms of use of gift certificates
The holder of a gift certificate has the right to use the Club's services within the face value indicated on it or the listed range of services.
The period during which the certificate is valid is indicated on the certificate itself.
Upon expiration, the certificate becomes invalid. The face value or services not used are cancelled without being transferred to another period.
Payment for a purchased gift certificate is not refunded, except for cases in which Ukrainian law directly requires a refund.
The certificate cannot be exchanged for money.
When the price of the selected services exceeds the certificate's face value, its holder may pay the difference calculated at the Club's current rates.
12. Club's obligations and powers
The Club's obligations include:
- provision of services paid for by the Client on the agreed terms;
- organization of the necessary briefing;
- control over compliance with safety rules;
- maintenance of Club weapons and equipment in proper technical condition;
- informing the Client about services and their prices with accurate information;
- compliance with the requirements of Ukrainian law.
The Club has the right to adjust the procedure for conducting a session or offer another service if required by safety or if providing the selected service is technically impossible.
13. Client's rights and obligations
The Client has the right to receive the paid services on the agreed terms, as well as information about their price and the procedure for providing them.
The Client bears the following obligations:
- provide accurate information needed for the provision of services;
- undergo the mandatory briefing;
- follow safety rules;
- comply with the instructor's commands;
- carefully and diligently use the Club's weapons, equipment, and other property;
- refrain from actions that threaten the life or health of other people.
14. Liability of the Club and the Client
The grounds and limits of liability of the Club and the Client are determined by this Public Offer and by Ukrainian law.
In cases and within the limits provided for by Ukrainian law, the Client is liable for damage to the Club's property or to third parties caused by intentional actions, negligence, non-compliance with safety rules, or failure to follow the instructor's commands.
The Club is not liable for the consequences of the Client's non-compliance with safety rules or failure to follow lawful demands and commands of the instructor, if such consequences were not caused by the Club's actions or inaction.
The terms of this Public Offer do not narrow the Club's liability where such limitation is not permitted by Ukrainian law.
15. Photography and video recording
The Client may take photos and video in places permitted by the Club, provided that there is no danger or obstruction to the conduct of training.
To ensure the safety and protection of visitors, staff, and property, the Club may conduct video surveillance on its premises in accordance with Ukrainian law.
The Client's image may be used in advertising, informational materials, or the Club's social media only on an appropriate legal basis and with the Client's consent in cases required by law.
16. Processing of personal data
For booking and service provision, the Club may collect the Client's name, phone, email address, and other data necessary for providing services.
Processing of personal data is carried out to arrange and fulfill a booking, make payments, communicate with the Client, comply with legal requirements, and for other lawful purposes.

17. Force majeure and safety-related restrictions
If the provision of services is impossible or delayed due to circumstances beyond the Club's reasonable control, the Club is not liable for this. Such circumstances include, in particular, military actions, air raid alerts, accidents, power outages, decisions of state authorities, and other emergency events.
Upon the occurrence of these circumstances, the Club has the right to suspend a session or adjust the procedure of its conduct in accordance with safety requirements.
With respect to a paid but unprovided portion of a service, the Club offers to reschedule the booking or apply another means of settlement, taking into account the circumstances and requirements of Ukrainian law.
18. Appeals and dispute resolution
A Client may address a complaint to the Club administration in person, by phone, or by email.
To resolve a dispute, the Club and the Client will seek to reach agreement through negotiations.
If agreement cannot be reached, the dispute is subject to resolution under Ukrainian law.
19. Validity of the offer and its updates
The Public Offer takes effect on the day it is posted on the Club's website.
The Club may change its terms by publishing a new version.
The agreed terms and the version of the offer in effect at the time of concluding the relevant contract apply to each booking, except in cases established otherwise by Ukrainian law.
